Konkurrenceretten i EU

Bogen behandler de EU-konkurrenceretlige regler for virksomhederne. Dette vedrører EF-traktatens artiekl 81 om konkurrencebegrænsende aftaler, artikel 82 om misbrug af en dominerende markedspoaition, artikel 86 om offentlige virksomheder samt reglerne om fusionskontrol. Endvidere behandles procedurereglerne for behandlingen af konkurrencesager og fusioner. I tilknytning hertil behandles den konkurrenceretlige regulering i EØS-landene.

Denne 3. udgave af bogen omfatter de seneste års tilpasninger af de EU-konkurrenceretlige regler. Flere af bogens kapitler er helt eller delvist omskrevet.

Aims and Values in Competition Law

With the Lisbon Treaty the principle of undistorted competition disappeared from the EU Treaty itself and was moved to a Protocol and the principle of social market economy was introduced. Together with the economization of competition law this has provoked a debate on the role of competition law in EU.

The book is the result of a research conference in September 2012 at the Law Faculty at Copenhagen University.

This book brings together essays by leading legal scholars from a number of European countries on European legal method(s).This in many respects rather pioneering project examines the extent to which it is possible to identify a coherent legal method (doctrine of the sources of law and their interpretation) that may be applied when analysing the multi-level legal EU order.

The book contains ten contributions (written by altogether thirteen authors), each of which addresses different dimensions of the general theme. It starts with two contributions under the heading: 'General Perspectives'. They are written by Janneke Gerrards and Jan Smits. The general heading for the next six articles is 'Changes in the Relative Importance of Sources of Law'. They are written by Ruth Nielsen; Martin Scheinin; Xavier Groussot, Laurent Pech and Gunnar Thor Petursson; Loïc Azoulai; Constanze Semmelmann and Linda Senden. The last two contributions of the book are presented within the headline 'Law in Context'. The first is the contribution by Ulla Neergaard and Marlene Wind and the last is written by Ernst-Ulrich Petersmann.

The book is an element in the research project: 'Towards a European Legal Method: Synthesis or Fragmentation?' (ELM), which is funded by the Danish Social Science Research Council for the years 2010-2012. This book is the second publication in the European research project.

The Role of Courts in Developing a European Social model

This book brings together essays by leading legal scholars from a number of European countries on the trends in the development - and the theoretical and methodological implications - of the European courts' role(s) in developing a European Social Model. The focus of the essays is on the role of the courts at both national and supra-national level. The term European Social Model is used in a broad sense as referring to any kind of a European model of society. The essays are based on papers presented at a research conference held at the Copenhagen Business School, Denmark, on 18 September 2009.

The book contains ten contributions altogether, each of which addresses different dimensions of the general theme. The three contributions in Part One represent a horizontal approach to the European courts' role(s) in the development of the European Social Model in that each essay examines the courts' treatment of issues arising across different subject areas. Part Two includes contributions that consider the courts' role(s) in a specific subject area: Spaventa on citizenship, Rönnmar on labour, and Roseberry on fundamental rights. The final part consisting of four essays investigate more explicitly theoretical and methodological aspects.
