Studieudgave

"Dansk retshistorie" og vestlig forfatningsudvikling er en studiebog rettet mod jurafaget af samme navn. Undervisningen er bygget op om den forfatningsretlige udvikling, både som den kommer til udtryk i den retsfilosofiske litteratur og i den realpolitiske virkelighed. Den danske forfatningsudvikling står i centrum, men bliver suppleret af tekster, der omhandler forfatningsretten i en række centrale vestlige stater.

De såkaldte frihedsrettigheder står centralt i den moderne forfatningsret, idet beskyttelsen af det enkelte individ mod overgreb fra statens side, bliver anset som et fundament for de vestlige demokratier. Studiebogen fokuserer på to af de traditionelle frihedsrettigheder; den første er ejendomsrettens beskyttelse, hvor en række tekster er udvalgt for at illustrere, hvordan synet på det at eje ændrede sig gennem tiden. Den anden er retten til privatliv, hvor et enkelt element, den seksuelle frihed er udvalgt, og hvor fokus er på homoseksualitet og bestialitet.

Bogen består hovedsageligt af kilder suppleret med indledninger og forklarende tekster, og dertil kommer et par længere artikler, der lægger op til diskussion. Det er tanken, at hæftet skal læses på baggrund af Ditlev Tamms lærebog i retshistorie. For at lette samspillet mellem de to værker er hvert tema udstyret med en indledning, hvor der blandt andet henvises til de sider i retshistorien, der supplerer studiebogen.

Mange af teksterne er for tilgængelighedens skyld blevet moderniseret, ligesom de fleste fremmedsprogede tekster er oversat.

This volume contains the proceedings from the conference “How Nordic are the Nordic Medieval Laws? – Ten Years After” which was held at the Carlsberg Academy in May 2013 in Copenhagen. 

The main theme of the conference was a return to the question raised at the first conference held back in 2003: The Nordic medieval laws seen in a European context. In these ten years the interpretation of the Nordic laws has changed from a specific Nordic to a more common European perspective, understanding the Nordic laws as a part of a common European tradition. Thus, the traditional interpretation that the Nordic medieval laws were expressions of an ancient Nordic culture has been under change since the first Carlsberg conference and this volume sums up the current stage of research and raises new questions.
